Kentucky Sues Kalshi for Alleged Illegal Gambling Operations

Kentucky Resident Seeks Damages from Kalshi Over Alleged Gambling Activities

The lawsuit was submitted on May 11 in the U.S. District Court for the Western District of Kentucky by resident Donovan Roberts. Roberts is pursuing compensation on behalf of a larger group of individuals who reportedly suffered financial losses due to their use of the platform.

According to the complaint, Kalshi operates an online marketplace where users can trade contracts linked to the outcomes of real-world events, such as elections, sporting contests, and weather patterns. While the company refers to these instruments as financial products, the suit contends they function more like real-money wagers.

The filing further asserts that these offerings fall outside Kentucky’s legal framework. Although the state permits sports betting—but only when conducted through licensed and regulated channels—the plaintiff maintains that Kalshi has not obtained the required authorization to operate such services within the state.

In response, the lawsuit aims to reclaim funds lost by residents of Kentucky under a statute that allows recovery of money forfeited through illegal gambling. This law not only provides a mechanism for affected individuals to seek restitution but also acts as a deterrent against unlawful wagering activities.

Class Action Highlights Concerns Over Social Harm

The litigation names several entities affiliated with Susquehanna and other organizations connected to Kalshi as defendants. The complaint argues that the platform has maintained ongoing connections with users in Kentucky via its website and payment systems, thereby establishing sufficient grounds for jurisdiction in the state.

The suit also emphasizes the constant accessibility of these platforms, noting that users can engage at any time from nearly anywhere using internet-connected devices. It draws a comparison between this seamless access and that of traditional gambling establishments, albeit without physical limitations.

Additionally, the filing raises broader concerns regarding social consequences. It references research indicating that digital platforms resembling betting environments may contribute to financial difficulties, relationship tensions, and mental health challenges. Younger demographics are identified as especially vulnerable, with studies suggesting that early exposure to such applications may heighten the risk of future gambling behavior.

Roberts is attempting to represent a statewide class of individuals who have sustained significant losses over an extended period.
